This website is operated by Cocove, ABN 39 106 332 480 (“Cocove”, “we”, “us” or “our”).
Cocove operates this online store and website, including all related information, content, features, tools, products and services (collectively, the “Services”). Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.
These Terms of Service (“Terms”) explain your rights and responsibilities when you access our website, use our Services or purchase products from us. These Terms apply together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies or terms displayed on our website.
By accessing or using our Services, you agree to these Terms. If you do not agree, you must not use our Services.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or protection that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to place an order through our website.
When creating an account or placing an order, you agree to provide information that is accurate, current and complete.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. Please contact us promptly if you believe your account has been accessed without authorisation.
We may suspend or restrict access to an account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms.
SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, photographs, measurements, colours, prices and other information displayed on our website are accurate.
Colours and product appearance may vary slightly depending on screen settings, lighting, photography and natural variations in materials. These reasonable variations do not affect your rights where a product is faulty, materially different from its description or otherwise fails to comply with the Australian Consumer Law.
Product measurements are approximate unless expressly stated otherwise.
We may update product descriptions, specifications or availability when reasonably necessary. Changes will not affect orders already accepted unless we contact you and obtain your agreement or the change is required by law.
Products may be discontinued or subject to purchase limits due to availability, safety considerations or other legitimate business reasons.
SECTION 3 — PRODUCT USE AND SAFETY
Cocove products must be used for their intended purpose and in accordance with any instructions, warnings or care information supplied with the product.
Before beginning a new exercise program or using fitness equipment, you should consider whether the activity is appropriate for your health, fitness, experience and circumstances. Seek advice from an appropriately qualified health professional where necessary, particularly if you are pregnant, injured, recovering from surgery or have a medical condition.
Stop using a product immediately if it appears damaged, defective or unsafe, or if its use causes pain, dizziness or unusual discomfort.
Children must be appropriately supervised around fitness equipment. Products should be stored securely when not in use.
This section does not exclude or limit any liability Cocove may have under the Australian Consumer Law or for loss that cannot lawfully be excluded.
SECTION 4 — ORDERS AND ACCEPTANCE
When you submit an order, you are offering to purchase the products in your order subject to these Terms.
An automated order confirmation acknowledges that we have received your order. Your order is accepted when we confirm acceptance or dispatch the products, whichever occurs first.
We may decline or cancel an order before acceptance where reasonably necessary, including where:
(a) a product is unavailable;
(b) there is an obvious pricing, description or inventory error;
(c) payment cannot be authorised;
(d) we reasonably suspect fraud, unauthorised activity or commercial resale;
(e) delivery is unavailable to the nominated address; or
(f) accepting the order would breach a law or regulatory requirement.
If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method. This does not limit any other rights you may have.
Please review your order carefully before submitting it. If you need to request a change or cancellation, contact us as soon as possible at admin@cocove.com.au. We cannot guarantee that an order can be changed or cancelled after processing or dispatch has commenced.
SECTION 5 — PRICES, GST AND PAYMENT
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars and include applicable GST.
Shipping charges and any other applicable costs will be shown before you complete checkout.
We may change prices at any time, but a price change will not affect an order already accepted.
If a price is clearly incorrect due to an obvious error, we may contact you before accepting the order and give you the option to proceed at the correct price or cancel the order for a full refund.
You agree to provide accurate and authorised payment information. Payment may be processed by Shopify or another third-party payment provider. Your use of a third-party payment service may also be subject to that provider’s terms and privacy policy.
Discounts, promotional codes and special offers are subject to any additional conditions displayed with the promotion. Unless expressly stated otherwise, promotions cannot be combined, exchanged for cash or applied retrospectively.
SECTION 6 — SHIPPING AND DELIVERY
Shipping options, charges, estimated delivery times and any applicable weight or location restrictions are described in our Shipping Policy and at checkout.
Delivery dates are estimates rather than guaranteed dates unless we expressly agree otherwise.
We will take reasonable steps to dispatch and deliver orders within the estimated timeframe. We are not responsible for delays caused by events outside our reasonable control, but we will provide reasonable assistance where a delivery is delayed, lost or damaged in transit.
Risk in a product passes to you when the product is delivered to you or to a person authorised by you to receive it. Ownership passes when we receive full payment and the product is delivered.
You are responsible for providing an accurate and accessible delivery address. Additional costs caused by an incorrect address or an unsuccessful delivery may be charged where those costs were reasonably incurred and were not caused by us.
Nothing in this section limits your rights under the Australian Consumer Law, including where goods are not supplied within an agreed or reasonable time.
SECTION 7 — RETURNS, REFUNDS AND CONSUMER GUARANTEES
Returns, exchanges and change-of-mind requests are handled in accordance with our Refund Policy.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Depending on the circumstances and the requirements of the Australian Consumer Law, available remedies may include repair, replacement, refund or compensation.
Any change-of-mind return offered by Cocove is provided in addition to, and does not replace or limit, your rights under the Australian Consumer Law.
To report a faulty, damaged, incorrectly supplied or materially misdescribed product, contact admin@cocove.com.auwith your order details and relevant photographs where reasonably available.
SECTION 8 — PRE-ORDERS AND AVAILABILITY
Where a product is offered for pre-order, the estimated dispatch timeframe will be displayed on the product page or communicated to you.
Pre-order dates are estimates and may change due to manufacturing, freight, customs or other circumstances outside our reasonable control.
If a significant delay occurs, we will provide an update and any options required by applicable law. Your rights under the Australian Consumer Law remain unaffected.
SECTION 9 — INTELLECTUAL PROPERTY
Unless otherwise stated, the website and its content, including the Cocove name, logos, trademarks, product designs, photographs, videos, graphics, written content and website design, are owned by or licensed to Cocove and are protected by applicable intellectual property laws.
You may access and use the website for personal, lawful and non-commercial purposes.
You must not reproduce, modify, publish, distribute, sell, commercially exploit or create derivative works from our content without our prior written permission, except where permitted by law.
Cocove’s trademarks, logos and branding must not be used without our prior written consent.
Third-party trademarks displayed on the website remain the property of their respective owners.
SECTION 10 — ACCEPTABLE USE
You must not use our website or Services:
(a) for an unlawful, fraudulent or malicious purpose;
(b) to infringe the rights of Cocove or another person;
(c) to transmit viruses, malware or harmful code;
(d) to gain unauthorised access to accounts, systems or information;
(e) to collect personal information about others without lawful authority;
(f) to interfere with the security, availability or operation of the website;
(g) to send spam or unsolicited promotional material;
(h) to impersonate another person or misrepresent your identity; or
(i) in a way that could reasonably harm Cocove, Shopify, our customers or another person.
We may restrict access to the Services where we reasonably believe these requirements have been breached.
SECTION 11 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
Our website may provide access to features, applications, payment services or other tools supplied by third parties.
We do not control every aspect of these third-party services. Your use of them may be subject to separate terms and privacy policies imposed by the relevant provider.
To the extent permitted by law, Cocove is not responsible for a third-party service that is independently provided and outside our reasonable control.

These links are provided for convenience and do not necessarily mean that Cocove endorses or controls the third-party website, its content or its practices.

Cocove is not responsible for loss caused solely by a third-party website or service outside our reasonable control, except to the extent responsibility cannot lawfully be excluded.
SECTION 13 — SHOPIFY
Our online store is hosted by Shopify.
Products purchased from Cocove are sold by Cocove, not Shopify. Cocove is responsible for fulfilling orders and addressing customer enquiries, returns and remedies relating to products purchased directly from our store.
Shopify may collect and process information as necessary to host and operate the ecommerce platform. Further information is available in our Privacy Policy and Shopify’s applicable privacy documentation.
SECTION 14 — PRIVACY
We collect, use, store and disclose personal information in accordance with our Privacy Policy and applicable privacy laws.
By using our Services, you acknowledge that personal information may be processed by Shopify and other service providers that assist us with payments, order fulfilment, delivery, communications, analytics and website operation.
Some service providers may process information outside Australia. Please review our Privacy Policy for further details.
SECTION 15 — REVIEWS, FEEDBACK AND USER CONTENT
If you submit a review, photograph, comment, suggestion or other content to Cocove (“User Content”), you confirm that:
(a) you own the content or have permission to submit it;
(b) it is accurate and not misleading;
(c) it does not infringe another person’s intellectual property, privacy or other rights;
(d) it is not unlawful, defamatory, abusive, obscene or malicious; and
(e) it does not contain harmful code.
You grant Cocove a non-exclusive, worldwide, royalty-free licence to use, reproduce and display User Content for operating, improving and promoting Cocove and its products, subject to applicable privacy and consumer laws.
Where reasonably practicable, we will not materially alter the meaning of a customer review.
We may moderate or remove User Content where we reasonably believe it is unlawful, misleading, offensive, fraudulent or in breach of these Terms. We will not suppress or manipulate genuine reviews in a misleading manner.
SECTION 16 — ERRORS AND CORRECTIONS
We may correct genuine typographical errors, technical errors, inaccurate stock information or omissions on the website.
If an error materially affects an order you have placed, we will contact you and provide the options required by applicable law.
Nothing in this section permits Cocove to make a misleading representation or avoid an order merely because it is no longer commercially convenient.
SECTION 17 — WEBSITE AVAILABILITY
We aim to keep our website secure and available but cannot guarantee uninterrupted or error-free access.
We may temporarily suspend access for maintenance, security, technical issues or circumstances outside our reasonable control.
To the extent permitted by law, we are not liable for temporary website unavailability that is outside our reasonable control. This does not affect liability that cannot lawfully be excluded.
SECTION 18 — DISCLAIMER
Information provided through our website, including fitness, movement and lifestyle content, is general information only and is not medical, physiotherapy or other individual professional advice.
You are responsible for deciding whether a particular activity or product is suitable for your circumstances and for obtaining professional advice where appropriate. To the maximum extent permitted by law, we exclude implied terms that may lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies:
(a) the consumer guarantees under the Australian Consumer Law;
(b) liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded; or
(c) any right or remedy that cannot lawfully be excluded, restricted or modified.
SECTION 19 — LIMITATION OF LIABILITY
To the extent permitted by law, Cocove is not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or wrongful conduct. Where Cocove is permitted by law to limit liability for a failure to comply with a guarantee, our liability will be limited only in the manner permitted by the Australian Consumer Law. Nothing in these Terms limits liability for personal injury, death, fraud, wilful misconduct or any other liability that cannot lawfully be limited.
SECTION 20 — INDEMNITY
You are responsible for loss reasonably suffered by Cocove as a direct result of your unlawful use of the Services, your infringement of another person’s rights or your material breach of these Terms. You will not be responsible under this section to the extent that the loss was caused or contributed to by Cocove, Shopify or another third party, or could reasonably have been avoided by Cocove. Nothing in this section excludes or limits your rights under the Australian Consumer Law.
SECTION 21 — EVENTS OUTSIDE OUR CONTROL
Neither party will be responsible for delay or failure caused by an event outside their reasonable control, except for an obligation to pay an amount already due. If such an event materially delays an accepted order, we will communicate with you and provide any remedy or option required by applicable law.
SECTION 22 — TERMINATION
You may stop using our website at any time. We may suspend or terminate access to the Services where reasonably necessary because of unlawful conduct, fraud, misuse, a material breach of these Terms, a security risk or a legal requirement.Termination does not affect rights and obligations that arose before termination or provisions that are intended to continue, including intellectual property, liability, governing law and accrued payment obligations.
SECTION 23 — SEVERABILITY
If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be read down to the minimum extent necessary or severed if it cannot be read down. The remaining provisions will continue to operate.
SECTION 24 — NO WAIVER
If Cocove does not immediately enforce a right under these Terms, that does not mean we waive that right. A waiver is effective only if it is provided in writing and applies only to the particular circumstances for which it is given.
SECTION 25 — ENTIRE AGREEMENT
These Terms and the policies incorporated by reference form the agreement between you and Cocove concerning your use of the Services and purchases from our online store. Nothing in this section excludes liability for misleading or deceptive conduct or any representation that cannot lawfully be excluded.
SECTION 26 — ASSIGNMENT
You must not assign your rights or obligations under these Terms without our prior written consent, which will not be unreasonably withheld. We may transfer our rights or obligations as part of a genuine sale, restructure or transfer of the Cocove business, provided that doing so does not reduce your existing rights and is permitted by law.
SECTION 27 — GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia. You and Cocove submit to the courts of Queensland and any courts entitled to hear appeals from those courts. Nothing in this section prevents you from exercising any right you may have to bring a claim in another jurisdiction under applicable consumer law.
SECTION 28 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal obligations.The current version will be published on this page with the date it was last updated. Changes will apply from the stated effective date and will not retrospectively remove or reduce rights relating to an order already accepted. Where a change materially affects registered customers or an ongoing Service, we will provide reasonable notice where required by law.
